D4PC has previously expressed concern over the impact that PPACA would have on Medicare Advantage. We have also questioned HHS's program to implement an $8.35 billion demonstration program to isolate Medicare Advantage from those cuts - at least through the election. This issue is again making news following a July 11, 2012 Government Accountability Office letter to HHS Secretary Sebelius. The letter states: "we remain concerned abou the agency's legal authority to undertake the demonstration." Is this another example of HHS ignoring the law, spending money it has no legal authority to spend simply for political purposes? Time will tell but it looks like the answer is "yes."
